ABOUT BASKIT

Baskit is a legal entity in the form of a Limited Liability Company whose scope of business activities is in the field of supply chain empowerment services by providing unlimited services for commercial support, financing and digital solutions for distribution businesses.

The following Terms of Service is a legally binding contract between you, the user (“You” or (“User”) and PT Baskit Technology Aplikasi ("Baskit" or "We") governing your access to and use of the Baskit platform, which includes its website, mobile application, content, services and features. Please read these terms of service carefully. By accessing, browsing and using Baskit in any way, , You acknowledge that You have read, understood, and agreed to be bound by these terms and conditions, without limitation or exception.. These terms and conditions apply to all users of Baskit, including but not limited to individuals, businesses, and organizations

GENERAL

Changes to Terms of Service. Baskit may at any time change, modify, add or reduce these Terms of Service and remain binding on the User for any replacement, change or reduction of the Terms of Service. You should review this Terms of Service page periodically to stay abreast of the Terms of Service that apply and are binding on you. By continuing to use the Baskit Platform following any changes, you are deemed to have agreed and accepted all such changes.
Registered Users. Some services on the Baskit website or application are only available to Userswho have registered. Registered User is a user who has successfully created an account with a unique username or an email and password, and has completed all verification steps necessary to become an active User on the Baskit Platform. As a registered User, you are required to follow these Terms of Service.
Added Terms of Service. Some areas or services of Baskit, such as pages where you can upload or download documents or files, may have usage guidelines and rules that may be in addition to these Terms of Service. By using these areas or services, you agree to be bound by the applicable instructions and rules for use.
Baskit feature changes. The Manager has the right not to continue a service or change services or features on Baskit at any time and without prior notification to the User.

USER OBLIGATIONS AND DECLARATIONS

In using the Baskit Platform, you are prohibited from:

using Baskit Platform in a way that could damage, overload, or disrupt Baskit's servers or network. Additionally, User are forbidden from unauthorized access to any system or User account via hacking or other unauthorized means.
using Baskit Platform for any unlawful purpose, including but not limited to illegal activities, fraud, or copyright infringement.
upload, post, download, or transmit any content that is obscene, indecent, hateful, threatening, or abusive, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, libelous, invasive of another's privacy, or racially, ethnically or otherwise objectionable.
sell or offer to sell any items or services that are illegal, counterfeit, or unsafe.
cause account access rights to be used by someone other than You, whether by lending, sharing, renting, transferring, or in any other way
infringing on the copyrights, trademarks, or other intellectual property of Baskit or any third party found on the Baskit Platform.
copy, modify, or distribute rights the website, content, products, or services of Baskit.
pretending to be someone else or another entity, or making false statements about oneself or one's affiliation with a particular person or group.
Baskit will cooperate fully with any officials and law enforcers or courts who request or direct Baskit management to reveal the identity of anyone posting material or information as mentioned above.

If You use the Baskit Platform, You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and You agree to accept responsibility for all activities that occur under your account or password. Transactions occurred in Baskit are consummated by adults, who can purchase with a credit card or other permitted payment method. If You are under eighteen (18) years of age, You may use the Services only with involvement of a parent or legal guardian.

PROHIBITED USE VIOLATIONS

If a violation of these Terms of Service is found, Baskit reserves the right to take any action it deems necessary, including but not limited to:

right to terminate your access to the Baskit Platform without prior notice, either temporarily or permanently.
Your IP address may be blocked to prevent further access.
In cases of serious legal violations, we reserve the right to report your actions to the authorities.

Termination of your subscription or membership due to a violation of these Terms of Service does not entitle you to a refund of any fees paid or to any claim whatsoever as a result of such termination.

TERMS OF SALE

Place an order
1. When you place an order for a product, you are deemed to have a desire to purchase the product in accordance with the following terms and conditions. All orders are subject to availability and confirmation of order price.
2. If your order is accepted, we will notify you via e-mail that your order is placed in our system and is awaiting payment. We will also inform you in the same e-mail regarding payment details along with the method.
3. When placing an order, you must provide all details correctly and accurately, that you are an authorized user of the debit card, credit card or bank account used to pay for your order. You must ensure that you have sufficient funds to cover the cost of your order. Costs of products and services may fluctuate. All prices advertised on the site are subject to such changes without prior notice to you.
Payment. When you order, you will receive an e-mail confirming receipt of your order and that your order is awaiting payment. Please note that this confirmation email will only be a confirmation and does not constitute a finalization of your order or the formation of a sales contract. To make your transactions easier, we've teamed up with various banks and payment service providers. You can choose the payment method that best suits your needs when shopping on Baskit. A sales contract will not be formed until we send you confirmation by e-mail that your payment has been received and that the goods you ordered will be sent to you. Baskit shall not be held responsible for any losses arising from payments made to any party other than those payment methods specified and communicated by Baskit.
Prices and Refunds. We will always do our best to ensure that all product details, descriptions, availability and prices contained on the Baskit website or app are accurate. However, errors may occur periodically. If we discover an error in the price or availability of a product you have ordered, we will immediately notify you of this and give you the option of resetting your order at the correct price or canceling it. If we cannot contact you or receive your acknowledgment within 3x24 hours, we will cancel the order. If you cancel but have already paid for the item, you will receive a full refund. If you are eligible for a refund due to a billing error, the refund amount will be calculated based on the error. Refunds will be issued within 30 business days to your registered bank account. Please note that subscription fees, transaction fees, and other fees are non-refundable.
Use of discount codes. Discount Codes may be offered to customers from time to time. The code can only be applied to purchases made through the account where the discount code is offered. Discount codes from one account cannot be transferred to another account.

As a supplement to the rights outlined above, a mandatory condition for securing a refund from Baskit is the presentation of a product unboxing video. This stipulation is applicable exclusively to the following cases:

If the User has paid more than the actual price of the product.
If the User agrees to accept only a portion of the product offered by the Seller.
If the Seller is clearly responsible for a delivery issue that results in the non-delivery of the ordered product.
If the Seller is unable to fulfill the order due to stock shortages, changes in shipping costs, or other reasons.
If the Seller has agreed to a delivery deadline but fails to ship the product by the agreed-upon deadline.
If the Resolution/Customer Center decides to issue a refund to the User or if Baskit makes such a decision.

We at Baskit strive to provide a seamless shopping experience. A confirmation of product receipt is mandatory for all Users upon delivery. Baskit provides a 3-day grace period from the time the delivery status is marked as "delivered" on the Baskit system for Users to confirm receipt. However, please be aware that once You've confirmed your order, You will be responsible for any issues that may arise after delivery.

SHIPPING TERMS

To ensure a smooth delivery process for your purchased products, Baskit has partnered with reputable logistics and postal service providers
All delivery services, associated costs, estimated delivery times, and guarantees provided to the User shall be fully managed and controlled by the logistics company appointed by Baskit. Information regarding these delivery services can be easily accessed by the User through the Baskit Platform
Any issues arising from the delivery process, including but not limited to product damage, delayed delivery, or loss of goods, shall be the sole responsibility of the relevant logistics company. Nevertheless, Baskit is committed to facilitating the resolution of disputes between the User and the logistics company. In this regard, the User hereby releases Baskit from any and all claims and damages that may arise from the delivery process.
if the User is dissatisfied with the quality of the delivery service provided by the logistics company, the User has the right to file a complaint with us or directly with the logistics company. The complaint procedure and applicable deadlines shall follow the terms and conditions set forth by the logistics company.

RIGHTS AND LICENSES

Right of ownership. All designs, images, artwork, text, audio, video and programming code (hereinafter referred to as "Content") on this site are copyrighted by Baskit. You are not permitted to modify, copy, change or add designs, images, artwork, text, audio, video and programming code to this facility under any circumstances or conditions.
Baskit Blog Use License
1. You are permitted to use blog content (Info and Tips) on the Baskit website or application only for personal purposes, not commercial purposes. You can use content that is permitted to be downloaded, such as photos, sound recordings and videos for personal purposes and in accordance with the regulations on the content in question.
2. You are not permitted to reproduce, print, copy, store, publish, display, distribute, modify, translate, publish, transfer, sell, lend, or distribute Baskit Content without written permission from Baskit.
Content Posted For Public Consumption
1. Some areas or services on Baskit allow you to post comment content that can be accessed and viewed by other visitors, including the public.
2. The manager does not claim ownership of the content you load. However, by posting content on Baskit's public areas, you guarantee us, our affiliates and distributors the right to use, copy, display, perform, distribute, adapt and promote that content in various media. User grants to Baskit a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to exercise any and all database rights and intellectual property rights that User has in the Content. User waives all moral rights and agrees not to assert any such rights against Baskit.
3. You agree that the content you post is only positive content that does not threaten, incite, harass, inflame, or encourage harassment of others, or interfere with other users' use of the site; or content that constitutes or encourages any form of criminal act that violates applicable laws or regulations or applicable international regulations. Violating any of the above provisions may involve a crime under applicable law and Baskit may report such violation and disclose your identity to the appropriate authorities.
Supervision. You agree that we are not responsible for content provided by other parties. We have no obligation to review such content, but we reserve the right to refuse to post or edit submitted content. We have the right to remove content contained in the Baskit website or application for various reasons, but we are not responsible for any failure or delay in removing such material.
Other Site Links
1. Baskit may provide links to third party sites, including links provided on search results pages. Some of these site links may contain objectionable, unlawful or inaccurate material. These links do not imply that we endorse such third party sites.
2. You acknowledge and agree that we are not responsible for the content or other materials on such third party sites. Any agreements and transactions between you and advertisers on Baskit are between you and the advertiser. You acknowledge and agree that we are not responsible for any losses or claims that may result from agreements or transactions between you and advertisers.
Applicable law. If you choose to access this site from outside Indonesia, you do so on your own initiative and are responsible for complying with applicable local laws. The Terms of Use will be governed by and interpreted in accordance with Indonesian law, without giving effect to the principles of conflicts of law.

LIMITATION OF LIABILITY

We are committed to providing useful services through the Baskit Platform. However, we understand that we cannot fully guarantee that the timing, accuracy, suitability, quality, security, and comfort of our website will always meet your expectations. While we will make every effort to ensure your security and comfort when using our Platform, we cannot assure you that it will always be safe or free from bugs and viruses.

To the extent permitted by applicable law, we are not liable to you or any third party for any loss or damage of any kind that may arise from your use of this website. This includes, but is not limited to, losses caused by computer viruses, data loss, or any other direct or indirect damages. If the law requires us to accept liability, you agree that our total responsibility for any claims arising from a breach of these Terms of Service will be limited to the amount you paid us for access to the services you selected.

APPLICABLE LAW

This User Agreement shall be governed by and construed in accordance with the laws of Indonesia, without giving effect to any principles of conflicts of law. You agree that any and all disputes arising in connection with this User Agreement (“Dispute”) shall be attempted to be resolved amicably within sixty (60) days of your notice to Us. If you choose to access this site from a location outside of Indonesia, you do so on your own initiative and are responsible for compliance with local laws.

INDEMNITY

You agree to defend, indemnify and hold Baskit including our affiliates, directors, officers, employees, contractors, consultants, and agents, and such Personnel of our affiliates, harmless from and against any loss, damage, liability, claim or demand, including reasonable attorneys' fees and court costs, made by any party in connection with your use of the Services, the content you provided or posted using the Services, your breach of this Agreement, your breach of any law or the rights of a third party , and any other acts or omissions relating to the Services.
